Second Reading: Russian State Duma to Introduce Million-Dollar Fines for LGBT Propaganda

The State Duma of the Russian Federation on Wednesday adopted in the second, main reading a bill providing for the introduction of large administrative fines, up to 10 million rubles, for propaganda of non-traditional sexual relations, pedophilia, and sex change among both minors and adults. 

Amendments are being made to the Code of Administrative Offences of the Russian Federation, in particular, to the article on fines for LGBT propaganda among minors. Fines are also imposed for propaganda among adults. Amendments to the second reading extend the article to the promotion of gender reassignment.

LGBT propaganda

According to the text of the bill, propaganda means the dissemination of information or public actions “aimed at the formation of non-traditional sexual attitudes”, their attractiveness, “a distorted view of the social equivalence of traditional and non-traditional sexual relations.” If these actions do not contain a criminal offense, then for citizens the fine will be from 50 thousand to 100 thousand rubles, for officials – from 100 thousand to 200 thousand rubles, for legal entities – from 800 thousand to 1 million rubles.

Propaganda among minors will entail increased fines. For citizens they will amount from 100 thousand to 200 thousand rubles, for officials – from 200 thousand to 400 thousand rubles, for legal entities – from 1 million to 2 million rubles or suspension of activity for up to 90 days.

Even higher fines are envisaged for propaganda on the Internet or in the media. If we are talking about propaganda among adults, then fines for citizens will amount from 100 thousand to 200 thousand rubles, for officials – from 200 thousand to 400 thousand rubles, for legal entities – from 1 million to 4 million rubles with the possibility of suspension of work.

For similar propaganda on the Internet or mass media among children, it is proposed for citizens to impose a fine from 200 thousand to 400 thousand rubles, for officials – from 400 thousand to 800 thousand rubles, for legal entities – from 2 million to 5 million rubles.

Demonstration of non-traditional relationships

Separately, the Administrative Code is supplemented by an article on responsibility for the demonstration of non-traditional relationships among minors or information that encourages a sex change. The fine for citizens will be from 50 thousand to 100 thousand rubles, for officials – from 100 thousand to 200 thousand rubles, for legal entities – from 800 thousand to 1 million rubles.

The dissemination of such information through the media or the Internet will entail an increase in fines. For citizens, the penalty will be up to 200 thousand rubles, for officials – up to 400 thousand rubles, for legal entities – up to 4 million rubles.

The bill provides for separate sanctions for foreigners and stateless persons. If they conducted LGBT propaganda among adults, the fine will be from 50 thousand to 100 thousand rubles, and if among minors – from 100 thousand to 200 thousand rubles. In both cases, fines are supplemented by administrative expulsion from the Russian Federation, which may be preceded by arrest for up to 15 days. If the propaganda was carried out by foreigners through the media or the Internet, then the amount of fines can be up to 100 thousand and up to 400 thousand rubles, depending on the age of the audience.

For demonstrating non-traditional relationships among children, foreigners also face expulsion with the possibility of administrative arrest for up to 15 days. They will also have to pay a fine of up to 100 thousand or up to 200 thousand rubles if the distribution went through the media or the Internet.

Propaganda of pedophilia

According to the bill, the propaganda of pedophilia is expressed in the dissemination of information aimed at its justification, as well as at the formation of its attractiveness. For citizens, the fine for this will be from 200 thousand to 400 thousand rubles, for officials – from 400 thousand to 800 thousand rubles, for legal entities – from 1 million to 4 million rubles.

For pedophilia propaganda on the Internet or the media, a fine of 400 thousand to 800 thousand rubles is provided for citizens, for officials the penalty will be from 800 thousand to 2 million rubles, for legal entities – from 4 million to 10 million rubles. The activity of legal entities in both cases can be suspended for up to 90 days.

As in the case of LGBT propaganda, for foreign citizens for pedophilia propaganda, expulsion is provided with a fine of up to 400 thousand or up to 800 thousand rubles, if it was conducted through the media or the Internet.
